Article 2 - Definitions
- Entrepreneur: XLsuperstores B.V., trading under the name LaadkabelXL.
- Customer: the natural person or legal entity who enters into an agreement with the entrepreneur.
- Consumer: the customer who is a natural person and is not acting in the course of a profession or business.
- Business customer: the customer acting in the course of a profession or business.
- Distance agreement: an agreement concluded via the online store, by e-mail, or by telephone, without the entrepreneur and customer being physically present at the same time.
- Withdrawal period: the period during which the consumer may exercise the right of withdrawal.
- Right of withdrawal: the consumer's option to withdraw from the distance agreement within the withdrawal period.
- Durable data carrier: any means, such as e-mail, that allows information to be stored in a way that enables it to be consulted unchanged at a later time.
Article 3 - Applicability
- These terms and conditions apply to every offer made by the entrepreneur and to every agreement concluded remotely via www.laadkabelxl.nl or in any other way.
- Before the agreement is concluded, the entrepreneur shall make these terms and conditions available via the website in a way that allows the customer to save and print them. They shall be sent free of charge upon request.
- Deviations from these terms and conditions are valid only if agreed in writing. Deviations to the detriment of the consumer are not permitted.
- The customer's general terms and conditions do not apply.
- If any provision of these terms and conditions is null and void or voidable, the remaining provisions shall remain in force. The provision in question shall be replaced by a provision that most closely approximates the purpose of the original provision.
Article 4 - The offer
- The offer contains a description of the products that is as complete and accurate as possible, enabling the customer to make a proper assessment. Images are a faithful representation; minor differences in color or design are possible.
- Obvious mistakes or errors in the offer, such as a clearly incorrect price, do not bind the entrepreneur.
- An offer is valid while stocks last, unless stated otherwise. Products that are temporarily out of stock may be offered as backorders; this will be clearly indicated with the product.
- The customer is responsible for choosing a product that is suitable for their vehicle and charging point. The business will be happy to provide advice upon request.
Article 5 - The agreement
- The agreement is concluded when the customer accepts the offer by completing the order.
- The business will immediately confirm receipt of the order by email. Until this confirmation has been sent, the customer may terminate the agreement.
- The business takes appropriate technical and organizational measures to secure the electronic transmission of data and payment.
- The business may refuse an order or attach conditions to it if there are valid reasons for doing so, for example if fraud is suspected. The customer will be notified as soon as possible, and any amounts already paid will be refunded.
Article 6 - Prices and payment
- All prices are in euros and include VAT. Any shipping costs will be clearly stated before the order is completed.
- Prices may be changed. For an order that has already been placed, the price applicable at the time of ordering applies.
- Payment is made using the payment methods offered at checkout. In principle, orders are not shipped until payment has been received.
- If a consumer does not pay on time, they will first receive a payment reminder granting a period of 14 days. Only after that may the business charge statutory interest and extrajudicial collection costs, within the limits of the law.
Article 7 - Delivery
- For products in stock: orders placed before 22:00 on business days will be delivered the next day in the Netherlands and Belgium, and within 1–3 working days elsewhere in the EU. This delivery period is a target period and not a strict deadline.
- Products purchased as backorders will be shipped as soon as the new stock arrives.
- The business will deliver no later than within 30 days, unless a longer period has been agreed. If this is not possible, the customer will be notified and may terminate the agreement free of charge. Any amounts already paid will then be refunded within 14 days.
- The risk of damage to or loss of the product passes to the consumer when the product is delivered to them or to a person designated by them.
- The customer must provide a correct delivery address. Additional costs resulting from an incorrect address or a package that is not collected in time may be charged, insofar as permitted by law.
Article 8 - Right of withdrawal
- The consumer may withdraw from a distance agreement during a 14-day withdrawal period without giving a reason. The withdrawal period begins on the day after receipt of the product or, in the case of an order delivered in multiple shipments, on the day after receipt of the final shipment.
- The consumer shall notify the withdrawal within the withdrawal period via info@laadkabelxl.nl or using the withdrawal form.
- Within 14 days after notifying the withdrawal, the consumer shall return the product, complete with all supplied accessories and, where possible, in the original packaging.
- During the withdrawal period, the consumer shall handle the product with care. The consumer may only unpack and inspect the product as they would in a shop. The consumer is liable for any reduction in value resulting from handling beyond that.
- The direct costs of returning the product are borne by the consumer, unless the product was delivered incorrectly or defective.
- The trader shall refund all payments made by the consumer, including standard shipping costs, as soon as possible and no later than 14 days after notification of the withdrawal. The trader may delay the refund until receiving the product or until the consumer demonstrates that they have returned it, whichever occurs first. The refund will be made using the same payment method, unless otherwise agreed. Additional costs for a more expensive shipping method than standard shipping will not be refunded.
- The right of withdrawal does not apply to products manufactured according to the consumer's specifications. The trader states this before the agreement is concluded.
Article 9 – Conformity and warranty
- The trader guarantees that the products comply with the agreement, the specifications stated in the offer and the reasonable requirements of soundness and usability (statutory warranty).
- A defect that becomes apparent within one year of delivery is presumed to have been present at the time of delivery, unless the trader proves otherwise.
- If a product is not in conformity, the consumer is entitled to free repair or replacement and, if that is not possible or reasonable, to a price reduction or termination of the agreement.
- The statutory warranty does not apply to defects caused by normal wear and tear, improper or careless use, use contrary to the instructions for use, connection to an unsuitable installation, external causes such as dropping, driving over the product or moisture, or repairs and modifications not carried out by or on behalf of the trader.
- The consumer must report a defect within two months of discovering it. The procedure is set out on the Warranty page.
Article 10 – Complaints
- The customer must report complaints about the performance of the agreement to the business in a complete and clearly described manner, via info@laadkabelxl.nl or the complaint form.
- The business responds to complaints within 14 days of receipt. If a complaint requires more time, the customer will receive an acknowledgement of receipt within that period and an indication of when they can expect a more detailed response.
- If the business and the customer cannot resolve the matter together, the dispute may be submitted to the competent court.
Article 11 – Liability
- The business's liability is limited to the amount the customer paid for the product concerned, unless the damage results from intent or wilful recklessness on the part of the business.
- The business is not liable for damage caused by incorrect use of the product, use contrary to the instructions for use, or use with an unsuitable electrical installation.
- These limitations do not apply insofar as the law does not permit them in relation to consumers, including statutory product liability.
Article 12 – Business customers
- The statutory right of withdrawal does not apply to business customers. However, for regular purchases, the business offers business customers the option to return products within 14 days of receipt, under the same conditions as those set out in Article 8, paragraphs 2 to 5.
- Business customers must pay within 14 days of the invoice date, unless otherwise agreed.
- Liability towards business customers is limited to the invoice amount for the product concerned. Liability for indirect loss, such as consequential loss, loss of profit and business interruption, is excluded.
Article 13 – Personal data
The business processes personal data carefully and in accordance with the General Data Protection Regulation (GDPR). More information is provided in the privacy policy.
Article 14 – Applicable law
- Agreements between the business and the customer are governed exclusively by Dutch law.
- If the consumer lives in another country, they retain the protection afforded to them by the mandatory provisions of the law of their country of residence.
Article 15 – Amendments to the terms and conditions
The business may amend these terms and conditions. The version in force at the time of ordering always applies to an agreement.
